TOWNSHIP OF LONG HILL ORDINANCE #109-02

AN ORDINANCE REQUIRING A MICROORGANISM PRETREATMENT PROGRAM FOR FOOD-HANDLING ESTABLISHMENTS AND SUPPLEMENTING AND AMENDING CHAPTER XXII OF THE TOWNSHIP CODE ENTITLED "SEWERS"

WHEREAS, Public Works Manager Gerald Testa and Waste Water Treatment Plant Operator Mario Bonaccorso have recommended that the Township adopt an ordinance requiring all food establishments to maintain their sewer works with the treatment of microorganisms; and

WHEREAS, such a program will improve the efficiency of the Township wastewater treatment system;

BE IT ORDAINED by the Township Committee of the Township of Long Hill in the County of Morris, New Jersey that Chapter XXII of the Township Code entitled "Sewers" is hereby supplemented and amended as follows:

Section 1.  The existing §22-13.7 entitled "Maintenance of Interceptors" is moved to §22-13.6 entitled "Interceptors" and labeled subparagraph "c" of §22.13.6.

Section 2. There is hereby created a new §22-13.7 entitled "Treatment of Microorganisms which reads as follows:

    22-13.7 Treatment of Microorganisms. All restaurants, retail food establishments, catering establishments, commercial food preparation facilities, meat processing facilities and similar facilities shall maintain their sewage works with treatment of microorganisms. The microorganism treatment shall be of a type approved by the sewer plant operator and shall be applied in accordance with the manufacturer's specifications.
Section 3.  Any and all other ordinances or parts thereof in conflict or inconsistent with any of the terms hereof are hereby repealed to such extent as they are so in conflict or inconsistent.

Section 4.  In case any article, section or provision of this ordinance shall be held invalid in any court of competent jurisdiction, the same shall not affect any other article, section or provision of this ordinance except insofar as the article, section or provision so declared invalid shall be inseparable from the remainder or any portion thereof.

Section 5.  This ordinance shall take effect immediately upon final passage and publication as required by law.

TOWNSHIP OF LONG HILL ORDINANCE #111-02

AN ORDINANCE CONCERNING PARKING REGULATIONS ON WARREN AVENUE, NORTHFIELD ROAD AND THE CRESCENT AND SUPPLEMENTING AND AMENDING CHAPTER VII OF THE TOWNSHIP CODE ENTITLED "TRAFFIC"

BE IT ORDAINED by the Township Committee of the Township of Long Hill in the County of Morris, New Jersey that Chapter VII of the Township Code entitled "Traffic" is hereby supplemented and amended as follows:

Section 1.  Section 7-14 entitled "Parking Prohibited at All Times on Certain Streets" is hereby supplemented and amended by adding the following locations in alphabetical order:

7-14  PARKING PROHIBITED AT ALL TIMES ON CERTAIN STREETS.

No person shall park a vehicle at any time upon any streets or parts thereof described.

Section 2.  §7-15 entitled "Parking Prohibited During Certain Hours on Certain Streets" is amended by amending the parking restrictions on Northfield Road to read as follows:

7-15.  PARKING PROHIBITED DURING CERTAIN HOURS ON CERTAIN STREETS.

No person shall park a vehicle between the hours specified any day (except Sunday and public holidays) upon any of the streets or parts of streets described.

TOWNSHIP OF LONG HILL ORDINANCE #112-02

AN ORDINANCE SUPLEMENTING AND AMENDING ORDINANCE 70-01 ENTITLED "FIXING THE SALARIES AND WAGES OF CERTAIN OFFICERS AND EMPLOYEES OF THE TOWNSHIP OF LONG HILL, COUNTY OF MORRIS, STATE OF NEW JERSEY"

WHEREAS, Ordinance 95-01 fixing salaries and wages for 2002 was adopted on November 28, 2001; and

WHEREAS, a new position has been created which requires the Township to supplement and amend Ordinance 95-01;

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Long Hill in the County of Morris, New Jersey that Ordinance 95-01 is hereby supplemented and amended as follows:

Section 1.  The salary and wage of the following employee of this Township shall be as follows and the maximum limit shall increase equivalent to the consumer product index (CPI) issued annually:

Emergency Management Coordinator/Administrator Assistant $37,500 - $51,000

Section 2.  Any and all other ordinances or parts thereof in conflict or inconsistent with any of the terms hereof are hereby repealed to such extent as they are so in conflict or inconsistent.

BE IT ORDAINED by the Township Committee of the Township of Long Hill in the County of Morris, New Jersey that Chapter VII of the Township Code entitled "Traffic" is hereby supplemented and amended as follows:

Section 1.  Section 7-14 entitled "Parking Prohibited at All Times on Certain Streets" is hereby supplemented and amended by adding the following location in alphabetical order:

TOWNSHIP OF LONG HILL ORDINANCE #114-02

AN ORDINANCE INCREASING FINES FOR VIOLATION OF MUNICIPAL ORDINANCES AND AMENDING CHAPTER I OF THE TOWNSHIP CODE ENTITLED "GENERAL PROVISIONS"

WHEREAS, Chapter 274 of the 2001 Session Laws increased from $1,000 to $1,250 the maximum fine that may be imposed for the first violation of a municipal ordinance;

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Long Hill in the County of Morris, New Jersey that Chapter I of the Township Code entitled "General Provisions" is hereby amended as follows:

Section 1.  Subsection 1-5.1 "Maximum Penalty" in section 1-5 "General Penalty" is amended by increasing the maximum fine for the first violation of a municipal ordinance from $1,000 to $1,250.

Section 2.  Any and all other ordinances or parts thereof in conflict or inconsistent with any of the terms hereof are hereby repealed to such extent as they are so in conflict or inconsistent.

Section 3.  In case any article, section or provision of this ordinance shall be held valid in any court of competent jurisdiction, the same shall not affect any other article, section or provision of this ordinance except insofar as the article, section or provision so declared invalid shall be inseparable from the remainder or any portion thereof.

Section 4.  This ordinance shall take effect immediately upon final passage and publication as required by law.

NOTICE

TOWNSHIP OF LONG HILL ORDINANCE #115-02


AN ORDINANCE CONCERNING ADMINISTRATIVE WAIVERS OF DEVELOPMENT PERMITS AND SUPPLEMENTING AND AMENDING SECTION 143 OF THE TOWNSHIP LAND USE ORDINANCE

WHEREAS, Ordinance 68-00 established a procedure by which the Township Engineer, in consultation with the Completion Review Committee (CRC) could issue administrative waivers of the requirements for development permits in specified cases; and

WHEREAS, Ordinance 90-01, which was a comprehensive revision of the Township’s Flood Damage Prevention Ordinance, did not include that provision from Ordinance 68-00; and

WHEREAS, the provision allowing the Township Engineer to waive the requirements for development permits in certain cases has worked well;

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Long Hill in the County of Morris, New Jersey that Section 143 of the Township Land Use Ordinance entitled “Flood Damage Prevention” is hereby supplemented and amended as follows:

Section 1.  Subsection 143.6 entitled “Waiver of Requirements” is supplemented and amended by adding a new paragraph “d” which reads as follows:

    “d. The Township Engineer, in consultation with the Completion Review Committee (“CRC”), may issue an administrative waiver of the requirements for a development permit in the following cases:
    1. The proposed development involves an existing or planned detached single-family residence, two-family residence or accessory structure; and
    2. The proposed development does not require approvals or permits from the New Jersey Department of Environmental Protection, Township Planning Board or Township Zoning Board of Adjustment.”

Section 2.  Any and all other ordinances or parts thereof in conflict or inconsistent with any of the terms hereof are hereby repealed to such extent as they are so in conflict or inconsistent.

Section 3.  In case any article, section or provision of this ordinance shall be held invalid in any court of competent jurisdiction, the same shall not affect any other article, section or provision of this ordinance except insofar as the article, section or provision so declared invalid shall be inseparable from the remainder or any portion thereof.

Section 4.  This ordinance shall take effect immediately upon final passage and publication as required by law.

NOTICE
