TOWNSHIP OF LONG HILL ORDINANCE #131-03

AN ORDINANCE AMENDING SEWER USER RATES AND AMENDING CHAPTER XXII OF THE TOWNSHIP CODE ENTITLED “SEWERS”

WHEREAS, Tax Collector Joan Donat in an April 29, 2003 memorandum to Township Administrator Kevin Sluka recommended that the sewer user rate for commercial users utilizing a combination of water company water and well water be amended so that all well water and all city water for the prior year is used to calculate the next year’s sewer usage;

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Long Hill in the County of Morris, New Jersey that Chapter XXII of the Township Code entitled “Sewers” is hereby amended as follows:

Section 1.  Subparagraph 2 of paragraph b - “Sewer Users with Wells” of §22-23 entitled “User Rates” is amended in its entirety to read as follows:

    “2. Commercial users utilizing a combination of water company and well water shall be charged a rate using the formula set forth in paragraph ‘a’ of this section. Paragraph ‘c’ of this section shall not apply and the amount of water consumed for users under this paragraph shall be determined by using the total water consumption for all four (4) quarters of the preceding calendar year.”

Section 2  Any and all other ordinances or parts thereof in conflict or inconsistent with any of the terms hereof are hereby repealed to such extent as they are so in conflict or inconsistent.

Section 3.  In case any article, section or provision of this ordinance shall be held invalid in any court of competent jurisdiction, the same shall not affect any other article, section or provision of this ordinance except insofar as the article, section or provision so declared invalid shall be inseparable from the remainder or any portion thereof.

Section 4.  This ordinance shall take effect immediately upon final passage and publication as required by law.

NOTICE

The foregoing ordinance having been introduced and passed on first reading by the Township Committee of the Township of Long Hill, in the County of Morris on Wednesday, May 14, 2003 will be considered for final passage and adoption at a public hearing held at a meeting beginning at 7:30 p.m. on Wednesday, June 11, 2003 at the Municipal Building, 1802 Long Hill Road, Millington, New Jersey when and where or at such time and place to which said meeting may be adjourned, all persons interested will be given an opportunity to be heard concerning said ordinance.

AN ORDINANCE FIXING THE SALARIES AND WAGES OF CERTAIN OFFICERS AND EMPLOYEES OF THE TOWNSHIP OF LONG HILL

BE IT ORDAINED by the Township Committee of the Township of Long Hill, in the County of Morris, State of New Jersey as follows:

Section 2.  The salary for Mayor and for the Township Committee shall be $6,000.00 and $5,000.00 respectively and shall be effective January 1,2003.

Section 3.  Any and all other ordinances or parts thereof in conflict or inconsistent with any of the terms hereof are hereby repealed to such extent as they are so in conflict or inconsistent.

Section 4.  This ordinance shall take effect immediately upon final passage and publication as required by law, unless the effective date is delayed pursuant to the provisions of N.J.S.A. 40A:9-165.

The foregoing ordinance having been introduced and passed on first reading by the Township Committee of the Township of Long Hill, in the County of Morris on Wednesday, May 14, 2003 will be considered for final passage and adoption at a public hearing held at a meeting beginning at 7:30 p.m. on Wednesday, June 11, 2003 at the Municipal Building, 1802 Long Hill Road, Millington, New Jersey when and where or at such time and place to which said meeting may be adjourned, all persons interested will be given an opportunity to be heard concerning said ordinance.

TOWNSHIP OF LONG HILL ORDINANCE #133-03

AN ORDINANCE REPEALING ORDINANCES THAT HAVE BEEN PREEMPTED BY THE NEW JERSEY CODE OF CRIMINAL JUSTICE AND AMENDING CHAPTER III OF THE TOWNSHIP CODE ENTITLED "POLICE REGULATIONS"

WHEREAS, the New Jersey Code of Criminal Justice provides in relevant part that: “[T]he local government units of this state may neither enact nor enforce any ordinance . . . preempted by, any provision of this code or with any policy of this state expressed by this code, whether that policy be expressed by inclusion of a provision in the code or by exclusion of that subject from the code . . . .” (N.J.S.A. 2C:1-5d); and

WHEREAS, N.J.S.A. 2C:33-15 provides in relevant part that: “Any person under the legal age to purchase alcoholic beverages who knowingly possesses without legal authority or who knowingly consumes any alcoholic beverage in any school, public conveyance, public place, or place of public assembly, or motor vehicle is guilty of a disorderly persons offense . . . .”; and

WHEREAS, Subsection 3-3.1 of the Township Code which prohibits possession or consumption of alcoholic beverages by minors has been preempted by N.J.S.A. 2C:33-15;

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Long Hill in the County of Morris, New Jersey that Chapter III of the Township Code entitled “Police Regulations” is hereby amended as follows:

Section 1.  Subsection 3-3.1 of the Township Code entitled “Possession or Consumption [of Alcoholic Beverages] by Minors” is hereby repealed in its entirety.

Section 2.  Any and all other ordinances or parts thereof in conflict or inconsistent with any of the terms hereof are hereby repealed to such extent as they are so in conflict or inconsistent.
