TOWNSHIP OF LONG HILL ORDINANCE # 99-02

AN ORDINANCE AMENDING ORDINANCE #52-00 (AS PREVIOUSLY AMENDED BY ORDINANCE #87-01) WHICH AUTHORIZED A PHASE II - I&I STUDY BY INCREASING THE AMOUNT APPROPRIATED FROM THE CONTRIBUTION IN AID OF CONSTRUCTION FUND-SEWER FROM $170,000 TO $240,000

WHEREAS, Ordinance #52-00 authorized a Phase II Infiltration and Inflow ("I&I") Study and appropriated $70,000 for the project; and

WHEREAS, Ordinance #87-01 increased the amount appropriated from $70,000 to $170,000; and

WHEREAS, additional monies are needed to complete the project;

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Long Hill in the County of Morris, State of New Jersey that Ordinance #52-00 entitled "An Ordinance Authorizing a Phase II-I&I Study and NJDEP Testing and Appropriating $70,000 Therefore From the Contribution in Aid of Construction Fund-Sewer" (as previously amended by Ordinance #87-01) is hereby amended as follows:

Section 1.  The amount appropriated from the Contribution in Aid of Construction Fund-Sewer in §3 of the ordinance is increased form $170,000 to $240,000.

Section 2.  In all other respects, Ordinance #52-00 as previously amended by Ordinance #87-01 shall remain in full force and effect.

Section 3.  The Capital budget is hereby amended to conform with the provisions of this ordinance to the extent of an inconsistency therewith and the resolutions promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director, Division of Local Government Services as on file with the (municipal clerk) (Clerk of the Board of Chosen Freeholders) [sic] and is available for public inspection.

Section 4.  This ordinance shall take effect immediately upon final passage and publication as required by law.

NOTICE

The foregoing ordinance having been introduced and passed on first reading by the Township Committee of the Township of Long Hill, in the County of Morris on Wednesday, January 17, 2002 [sic] will be considered for final passage and adoption at a public hearing held at a meeting beginning at 7:30 p.m. on Wednesday, February 13, 2002 at the Municipal Building, 1802 Long Hill Road, Millington, New Jersey when and where or at such time and place to which said meeting may be adjourned, all persons interested will be given an opportunity to be heard concerning said ordinance.

TOWNSHIP OF LONG HILL ORDINANCE # 100-02

AN ORDINANCE PROHIBITING SMOKING IN MUNICIPAL BUILDINGS, PARKS, PLAYGROUNDS AND RECREATION AREAS AND SUPPLEMENTING AND AMENDING CHAPTER III OF THE TOWNSHIP CODE ENTITLED "POLICE REGULATIONS" AND CHAPTER XI ENTITLED "PARKS AND RECREATIONAL AREAS"

WHEREAS, N.J.S.A. 2C:33-13 provides that: "Any person who smokes or carries lighted tobacco in any public place . . . where such smoking is prohibited by municipal ordinance under authority of R.S. 40:48-1 and 40:48-2 . . . and when adequate notice of such prohibition has been conspicuously posted, is guilty of a petty disorderly persons offense. Notwithstanding the provisions of 2C:43-3, the maximum fine which can be imposed for violation of this section is $200."; and

WHEREAS, the Township Committee wishes to prohibit smoking in all municipal buildings, parks, playgrounds and recreation areas;

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Long Hill in the County of Morris, New Jersey that Chapter III of the Township Code entitled "Police Regulations" and Chapter XI of the Township Code entitled "Parks and Recreational Areas" are hereby supplemented and amended as follows:

Section 1.  There is hereby created a new §3-11 entitled "Smoking Prohibited in Municipal Buildings, Parks, Playgrounds and Recreation Areas" which reads as follows:

    3-11  SMOKING PROHIBITED IN MUNICIPAL BUILDINGS, PARKS, PLAYGROUNDS AND RECREATION AREAS.

    3-11.1 Smoking Prohibited in Municipal Facilities. Smoking is hereby prohibited in all municipal buildings, parks, playgrounds and recreation areas and within twenty-five (25) feet of any entrance to a municipal building.

    3-11.2 Definitions. As used in this section:

      Municipal buildings shall mean all buildings used by Long Hill Township for governmental purposes and shall include:
      Town Hall - 1802 Long Hill Road
      New Town Hall - 914 Valley Road, Gillette
      DPW Garage
      Police Headquarters
      Public Library
      Sewer Plant
      [and shall include entire premises on which the buildings are located]

      Parks, Playgrounds and Recreational Areas shall include:
      Stirling Lake
      Meyersville Field
      Hicks Tract
      Little League fields
      Turtle Rock Park
      Carrington Tract athletic fields and recreational facilities

    3-11.3 Signs. Adequate notice of such prohibitions shall be conspicuously posted in all places set forth in §3-11.2 above.

    3-11.4 Violations and Penalties. Any person violating any provision of this section shall be liable to the penalties stated in Chapter I, §1-5 of this Code. The maximum fine which can be imposed for violations of this section shall be $200 or the maximum fine permitted by N.J.S.A. 2C:33-13 as supplemented and amended, whichever is greater.

Section 2.  §11-2 entitled "Regulations Pertaining to Long Hill Township Parks" is hereby supplemented and amended by adding a new subsection 11-2.7 entitled "Smoking Prohibited" which reads as follows:
 

    11-2.7 Smoking Prohibited. Smoking is prohibited in all Township parks and recreational areas in accordance with Township Code §3-11.

Section 3.  Any and all other ordinances or parts thereof in conflict or inconsistent with any of the terms hereof are hereby repealed to such extent as they are so in conflict or inconsistent.

Section 4.  In case any article, section or provision of this ordinance shall be held invalid in any court of competent jurisdiction, the same shall not affect any other article, section or provision of this ordinance except insofar as the article, section or provision so declared invalid shall be inseparable from the remainder or any portion thereof.

Section 5.  This ordinance shall take effect immediately upon final passage and publication as required by law.

The foregoing ordinance having been introduced and passed on first reading by the Township Committee of the Township of Long Hill, in the County of Morris on Wednesday, January 9, 2002 will be considered for final passage and adoption at a public hearing held at a meeting beginning at 7:30 p.m. on Wednesday, February 13, 2002 at the Municipal Building, 1802 Long Hill Road, Millington, New Jersey when and where or at such time and place to which said meeting may be adjourned, all persons interested will be given an opportunity to be heard concerning said ordinance.

TOWNSHIP OF LONG HILL ORDINANCE # 101-02

BOND ORDINANCE PROVIDING FOR CONSTRUCTION OF A NEW LIBRARY BUILDING BY THE TOWNSHIP OF LONG HILL, IN THE COUNTY OF MORRIS, NEW JERSEY, APPROPRIATING $3,060,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $2,914,000 BONDS OR NOTES OF THE TOWNSHIP FOR FINANCING SUCH APPROPRIATION

TOWNSHIP OF LONG HILL ORDINANCE # 102-02

PERMITTING 6' FENCES ON PAPER STREETS AND SUPPLEMENTING AND AMENDING § 154.1 OF TOWNSHIP LAND USE ORDINANCE

WHEREAS, the Township Planning Board has recommended amending the Township Land Use Ordinance so as to permit property owners to erect fences up to six-feet high along property lines that abut paper streets as outlined in Township Planner John Fussa's January 17, 2002 memorandum; and

WHEREAS, the Township Committee agrees with the Planning Board's recommendation;

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Long Hill in the County of Morris, New Jersey that §154 of the 1997 Land Use Ordinance (as supplemented and amended) entitled "Fences, Walls and Hedges, Street Furniture, Trash and Recycling Storage" is hereby supplemented and amended as follows:

Section 1.  Paragraph "c" of subsection 154.1 entitled "Fences, Walls and Hedges" is supplemented and amended by adding a new paragraph 5 which reads as follows:

    c. On any lot in any zone, no fence, wall or hedge shall be erected or altered so that said fence, wall or hedge shall be erected or altered so that said fence, wall or hedge shall be over four (4) feet in height in front yard areas and eight (8) feet in height in side and rear yard areas, with the following provisions and exceptions:
      5. Fences located in the front yard areas that abut a paper street may exceed four (4') feet in height with a maximum height of six (6'), provided there are no plans to convert said paper street to a road improved to Township standards. Where fences are located on corner lots, the height of said fence abutting a paper street shall not exceed four (4') feet in height forward of the front building line facing a street improved to Township standards. The Township Engineer shall determine the status of the paper street for the purpose of administering this section and clarifying whether there are plans to convert said paper street to a road improved to Township standards.

Section 2.  Any and all other ordinances or parts thereof in conflict or inconsistent with any of the terms hereof are hereby repealed to such extent as they are so in conflict or inconsistent.

Section 3.  In case any article, section or provision of this ordinance shall be held invalid in any court of competent jurisdiction, the same shall not affect any other article, section or provision of this ordinance except insofar as the article, section or provision so declared invalid shall be inseparable from the remainder or any portion thereof.

Section 4.  Section 4. This ordinance shall take effect immediately upon final passage and publication as required by law.

The foregoing ordinance having been introduced and passed on first reading by the Township Committee of the Township of Long Hill, in the County of Morris on Wednesday, February 27, 2002 will be considered for final passage and adoption at a public hearing held at a meeting beginning at 7:30 p.m. on Wednesday, March 13, 2002 at the Municipal Building, 1802 Long Hill Road, Millington, New Jersey when and where or at such time and place to which said meeting may be adjourned, all persons interested will be given an opportunity to be heard concerning said ordinance.

TOWNSHIP OF LONG HILL ORDINANCE # 103-02

AN ORDINANCE CONCERNING LOCAL ENFORCEMENT OF THE UNIFORM FIRE CODE AND AMENDING CHAPTER XVII OF THE TOWNSHIP CODE ENTITLED "FIRE PREVENTION"

WHEREAS, Chapter XVII of the New Jersey Administrative Code entitled "Uniform Fire Code" was recodified as N.J.A.C. 5:70, pursuant to Reorganization Plan No. 002-1998, effective July 1, 1998; and

WHEREAS, the citations in section 17-1 of the Township Code entitled "Local Enforcement of Uniform Fire Code" need to be updated to reflect the recodification of the Administrative Code;

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Long Hill in the County of Morris, New Jersey that Chapter XVII of the Township Code entitled "Fire Prevention" is hereby supplemented and amended as follows:

Section 1.  The citations throughout section 17-1 are amended to reflect the 1998 recodification of the New Jersey Administrative Code as described in the preamble.

Section 2.  Section 17-1 as amended, a copy of which is attached hereto and which is incorporated herein by reference, is hereby adopted.  Additions in text are indicated by underline; deletions by strikeouts.

Section 3.  Any and all other ordinances or parts thereof in conflict or inconsistent with any of the terms hereof are hereby repealed to such extent as they are so in conflict or inconsistent.

Section 4.  In case any article, section or provision of this ordinance shall be held invalid in any court of competent jurisdiction, the same shall not affect any other article, section or provision of this ordinance except insofar as the article, section or provision so declared invalid shall be inseparable from the remainder or any portion thereof.

Section 5.  This ordinance shall take effect immediately upon final passage and publication as required by law.
